1. Agreement and operator
These Terms and Conditions (“Terms”) are an agreement between you and vFFiliate LLC, a Florida limited liability company operating RankPulse (“RankPulse,” “we,” “us,” or “our”). If you use RankPulse for an organization, you represent that you have authority to bind that organization.
2. Eligibility and accounts
You must be at least 18 years old and able to form a binding contract. You must provide accurate account information, maintain control of your email account, and notify us promptly of suspected unauthorized access. You are responsible for activity by users you invite to your workspace.
3. Service
RankPulse tracks organic Google search positions for submitted websites, keywords, countries, and devices. Rank information is obtained through third-party data providers. Search results vary by time, location, personalization, data center, device, and other factors. RankPulse does not guarantee that reported positions will exactly match every manual search or that any website will achieve or maintain a particular position.
4. Trial
The 14-day trial permits one website and up to two keywords. Each trial keyword may receive one initial ranking check and one additional check after seven days, for no more than two checks during the trial. Trial access does not automatically convert into a paid subscription and may not be repeatedly created to avoid payment or plan limits.
5. Paid plans and renewal
Grow is $9.99 USD per month and currently permits up to five websites with ten keywords per website. Pro is $29.99 USD per month and currently permits up to twenty websites with thirty keywords per website. Enterprise features and prices are agreed separately. Paid subscriptions renew monthly until canceled. Taxes may be added where required.
Before checkout, you will be shown the price and renewal frequency. By completing checkout, you authorize Stripe and RankPulse to charge the selected payment method at signup and each renewal until cancellation.
6. Cancellation and refunds
You may cancel through the billing portal. Cancellation normally takes effect at the end of the current paid period. Payments are non-refundable except where required by law, as described in the Refund Policy.
7. Acceptable use
You may not: use RankPulse unlawfully; probe, scan, or test system vulnerabilities without written permission; interfere with the service; bypass quotas, access controls, or rate limits; use automated means against the service except documented interfaces; reverse engineer protected portions of the service; submit malware; misuse another person’s account or data; resell access without written permission; or create repeated trials to evade payment.
8. Customer data and permission
You retain rights in the websites, keywords, and other information you submit. You grant us a limited right to host, process, transmit, and display that data solely to operate, secure, support, and improve the service. You represent that you have the right to submit and process the data through RankPulse.
9. Intellectual property
RankPulse, its interface, software, branding, documentation, and original content are owned by vFFiliate LLC or its licensors and are protected by applicable law. These Terms provide a limited, revocable, non-exclusive, non-transferable right to use the service during an authorized trial or subscription; they do not transfer ownership.
10. Third-party services
RankPulse depends on services including search-result providers, hosting, authentication, databases, and payment processing. Third-party interruptions or changes may affect availability or results. Your use of Stripe-hosted billing features is also subject to Stripe’s applicable terms and privacy policy.
11. Suspension and termination
We may suspend or restrict access when reasonably necessary to address nonpayment, security risk, unlawful activity, abuse, material breach, provider requirements, or harm to RankPulse or others. You may stop using the service at any time. Sections that by their nature should survive termination—including payment obligations, intellectual property, disclaimers, liability limits, and dispute terms—will survive.
12. Service changes
We may modify features, limits, or these Terms. Material changes will be posted or communicated through reasonable means. Changes will not retroactively alter an already-paid billing period unless required for security, law, or third-party compliance.
13. Disclaimers
TO THE MAXIMUM EXTENT PERMITTED BY LAW, RANKPULSE IS PROVIDED “AS IS” AND “AS AVAILABLE.” WE DISCLAIM IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT UNINTERRUPTED OPERATION, ERROR-FREE DATA, OR ANY SEO, TRAFFIC, REVENUE, OR BUSINESS OUTCOME.
14. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, VFFILIATE LLC AND ITS AFFILIATES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR LOST PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITY. OUR TOTAL LIABILITY ARISING FROM THE SERVICE WILL NOT EXCEED THE GREATER OF $100 OR THE AMOUNT YOU PAID TO RANKPULSE DURING THE THREE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO THEY MAY NOT APPLY TO YOU.
15. Indemnification
To the extent permitted by law, you will defend and indemnify vFFiliate LLC from third-party claims, losses, and reasonable costs arising from your unlawful use of RankPulse, your submitted data, your violation of these Terms, or your infringement of another party’s rights.
16. Governing law and venue
These Terms are governed by the laws of the State of Florida, without regard to conflict-of-laws principles. Subject to any rights that cannot lawfully be waived, state and federal courts located in Miami-Dade County, Florida will have exclusive jurisdiction over disputes arising from these Terms or RankPulse.
17. General provisions
If a provision is unenforceable, the remaining provisions remain in effect. Failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them as part of a merger, reorganization, sale, or transfer of the service. These Terms, the Privacy Policy, Refund Policy, and checkout disclosures form the entire agreement concerning RankPulse.
